Legal Notice NOTICE OF APPLICATION FOR LIVESTOCK FEEDLOT PERMIT Notice is hereby given per Minnesota Statutes §116.07, subd. 7(a), that Mill Creek Dairy, will be applying to the Minne- sota Pollution Control Agency or the County of Stearns for a permit to construct a building to house a manure separator and stirring pit. The proposed construction project is located in the SW1/4 of Section 8 of Maine Prairie Town- ship, T122N, R29W, of Stearns County, Minnesota. Is owned by Gregory Agribusiness LLC. Currently, the feedlot has 420 head of dairy cows (588 animal units) housed in two total confine- ment barns with a liquid manure storage facility. The proposed proj- ect will include a 12&apos;x14'x8' deep stirring pit and a 56'x64' building to cover pit and manure separator. This publication shall consti- tute as notice to each resident and each owner of real property within 5,000 feet of the perimeter of the expanding feedlot as required by Minnesota State Law. Page 9 HHHHH Illl HHHHIII Accidents, convictions, crime blotters Man accidentally shoots self Sunday, Aug. 28, at about 3 p.m., a 911 call came to the Stearns County Sheriff's Office. The Sheriff's Office, Gold Cross Ambulance and Clearwater Rescue responded to the Kevin Matz residence on Woodbine Road in Lynden Township. Kevin Don Matz, age 43 of Clearwater had accidentally shot himself in the arm, and his wife Constance Jean Matz, age 40, made the 911 call. When the Stearns officer arrived, he found Matz attending to a wound on his left arm. Matz had been cleaning his handgun and at some point pulled the trigger on the loaded firearm, firing the gun and striking his arm. He was taken to the St. Cloud Hospi- tal for treatment of the injury. Train v car collision Thursday, Aug. 25, a 2001 black Saturn, driven by Michael Scott Johnson, age 50 of Glenwood was struck on the private railroad cross- ing about 4 miles east of Brooten. Johnson was southbound on the railroad crossing when the car got stuck on the railroad tracks. John- son abandoned the car before the car was struck. Minnesota State Patrol and Stearns County Sheriff's Department responded as emer- gency vehicles to the scene. A train headed eastbound hit the car and dragged it down the railroad bed for about half a mile. Noone was injured. Alcohol may have been a factor in the crash which is under investigation. Steams Co. convictions, June 2011 Jeffrey Gerard He/non, 48, of Kimball, was convicted of domestic assault; date of offense was March 27, 2011. Imposition of sentence was stayed; five years probation; 30 days in jail, may be served on elec- tronic home monoitoring; pay $50 fine plus surcharges; abstain from alcohol and non-prescribed mood- altering substances and complete outpatient chemical dependency treatment; random urinalysis; no contact with victim; sentenced June 9, 2011, by Judge Davick-Halfen. Travis Richard Summerlet, 23, of Kimball, convicted of aiding and abetting criminal damage to prop- erty in the first degree; date of offense was Jan. 8, 2010. Sentenced to 24 months in prison, execution stayed; five years probation; 75 days jail; pay $500 fine plus surcharges or com- plete community service work in lieu of fine; pay $1,120 in restitution joint and several; complete chemical dependency evaluation; abstain from alcohol and non-prescribed mood- altering substances; sentenced June 17, 2011, by Judge Scherer. Travis Richard Summeflet, 23 of Kimball, convicted of controlled sub- stance crime in the fifth degree (mar- ijuana); date of offense was Nov. 24, 2009. Sentenced to 21 months prison, execution stayed; five years proba- tion; 83 days jail; $300 fine plus sur- charges or complete community ser- vice work in lieu of fine; $250 in res- titution; complete a chemical depen- dency evaluation; abstain from alco- hol and non-prescribed mood-alter- ing substances; random urinaly- sis; sentenced June 17, 20il, by Judge Scherer.
