No accessory buildings on an internal lot may be located within ten (10) feet of the side or rear lot lines or from the des- ignated setback on a corner lot. No accessory build- ing shall exceed the height of the principal building. If detached, they shall not be located closer than six (6) feet from the principal structure. Subd. 11. User Recovery Cost. Each residential household, commercial complex, commercial busi- ness or industry shall pay to the City the established amount set forth by the base rate (minimum) charge for the proper operation of the sewage treatment plant, as set forth in the Schedule of Fees, Chapter 215. Every building, except those owned by the City, whether occupied or vacant, is subject to this base rate (minimum) charge. Any established multi-dwell- ing shall make payment in the amount established by the base rate (minimum) charge and the additional unit charge. Legal Notice RESOLUTION NO. 12202016F Resolution to Amend City Ordinance 810 - Sewer Service Charges WHEREAS, the City Council met on Tuesday, December 20, 2016, to amend Ordinance Section 810.02 to read as follows: Section 810.02: BASIS FOR SEWER SERVICE CHARGES. The sewer service charges for the use of, and for service supplied by, the City's sewer facilities shall consist of a base rate (minimum) charge, a usage charge, a sewer access charge, and a surcharge. WHEREAS, the City Council met on Tuesday, December 20, 2016, to amend Ordinance Section 810.03 to read as follows: Section 810.03: BASE RATE (MINIMUM) CHARGE. A base rate (minimum) charge shall be applied to all users, regardless of the volume of sewer or water use. The amount of the base rate (min- imum) charge shall be determined by the Council from time to time. All properties connected to the sewer system shall pay the base rate (minimum) charges regard- less of whether the service is used or not. WHEREAS, the City Council met on Tuesday, December 20, 2016, to amend Ordinance Section 810.04 to read as follows: Section 810.04: BASIC USER CHARGE. The base rate (mini- mum) charge for the use of, and for service supplied by, the City sani- tary sewer facilities shall be set in an amount sufficient to cover the City's cost of providing ser- vice, plus replacement cost. The adequacy of the base rate (mini- mum) charge shall be determined by the City Council and reviewed by the City Auditor in its annual audit report. The base rate (mini- mum) charge shall be revised peri- odically to reflect changes in debt service or in operation and main- tenance costs, including replace- ment costs. The usage charge shall be based on usage. Users who have no sewage meters shall be charged according to water usage as recorded by water meters. Users who have sewage meters shall be charged according to sewer usage as recorded by sewer meters. The usage charge shall be charged for wastes having normal concentra- tions. For purposes of this Section, the phrase "wastes having nor- mal concentrations" shall mean wastes which have a five-day, 20-degree Centigrade biochemi- cal oxygen demand (BUD) of not more than 300 ppm, and a sus- pended solids (SS) content of not more than 300 ppm. The usage charge shall be added to the base rate (minimum) sewer charge for persons whose sewer use exceeds the volume set by the Council for the base rate (minimum) sewer charge. This amendment is adopted the 20th day of December 2016, and shall be effective ]anuary 1, 2017.
